AGREEMENT TO OFFICIAL RULES
By participating, Entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

TERM
The “Astoria Warrenton Winter Getaway” sweepstakes begins at 8:00 a.m. PST on Monday, December 15, 2019 and ends at 5:00 p.m. PST on Friday, January 31, 2020.
All entries must be made via a new post with use of #AstoriaIs (Astoria is) on Instagram or Twitter.  Example: #AstoriaIs home or #AstoriaIs peaceful   

WHO MAY ENTER
Contest is open only to legal residents of the United States (excluding residents of Puerto Rico), and Canada except where prohibited by law, who are 18 years of age or older at the time of entry. Employees of Sponsor and partners, and its affiliates and subsidiaries, and their immediate family members (spouse, parent, sibling and their respective spouses, regardless of where they live) or persons living in the same households of such individuals, whether or not related, are not eligible to enter or win a prize. Promotion partners include Astoria-Warrenton Area Chamber of Commerce, B-Line Sustainable Urban Delivery, and those businesses who contributed to the prize package.)  CONTEST IS VOID IN PUERTO RICO AND WHERE PROHIBITED. 

HOW TO ENTER 
To enter, Entrants must use the contest hashtag #AstoriaIs on a new post during the contest period. Inappropriate content will be disqualified. By using the hashtag, the user indicates agreement that they have read and understand these terms and conditions. Limit one (1) entry per person/email address during the Promotion Period.  Comments on our post or another user's post with the #AstoriaIs will not be counted.

Weird Sisters Boutique - A $50 gift certificate to Weird Sisters Freak Boutique, a shop overflowing with quirky, strange and delightful fashions, housewares and oddities, that is also an immersive art installation.

DRAWING AND NOTIFICATION
The Prize winner will be selected in a random drawing from among all Entries received throughout the Sweepstakes Period. The Prize drawing will be conducted by the Sponsor, whose decisions are final and binding in all matters relating to this contest. The Grand Prize Winner will be contacted at the account by which they entered by close of business Monday, February 3, 2020. Odds of winning will depend on the total number of eligible Entries received.

No prize transfer, assignment or substitution by Winner permitted. Prize package is valid through December 30, 2020 unless otherwise specified on individual gift certificates. Lodging is subject to availability. See lodging certificate for additional details and confirm policies with property when making a reservation.

If the Winner does not claim his or her prize within 72 hours of notification, TravelAstoria.com will select an alternate winner.

The approximate retail value of this prize package is $1,300.00. Tips, taxes, insurance and all other expenses associated with acceptance and use of the prize not stated herein are the sole responsibility of each Winner and his/her travel companions. All prize details are at Sponsor’s sole discretion.

TERMS AND CONDITIONS APPLICABLE TO WINNER
Winner acknowledges and agrees that the Winner’s name and city/state may be published by Sponsor and their designees, licensees or affiliates (the “Authorized Parties”), on websites, or in any other medium, or in press releases associated with the contest. No Authorized Party will be required to pay any additional consideration or seek any additional approval from Winner in connection with such use. 
By accepting the prize, Winner acknowledges and agrees that Winner understands that travel, whether in developed or remote areas and whether by plane, automobile, motorcycle, boat, or other conveyance, or by foot, on land or water, and in the air, contains some inherent element of risk of accident, illness, injury, loss or death, which may be caused by negligence, forces of nature, wild animals or other agencies, known or unknown. Winner further acknowledges and agrees that such risks may be present at any time before, during and after the trip. In order to be considered a Winner and partake of the enjoyment of this trip, Winner must be willing to accept the risk, and to confirm acceptance of such risk in writing at Sponsor’s request.

GENERAL CONDITIONS              
Sponsor’s Right to Cancel Sweepstakes. If for any reason the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to (a) infection by computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice, or to award the prizes using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. 

Sponsor’s right to disqualify entry. Sponsor reserves the right, at its sole discretion, to disqualify any individual deemed to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or Sponsor’s Website; or (b) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. 

Waiver. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of a prize Winner based on an e-mail address, the winning entry will be declared by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
 
Release and Limitations of Liability. By participating in the Sweepstakes, Entrants agree to release and hold harmless the Sponsor, its respective officers, directors, employees, agents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. 

Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

Contest Availability. THIS CONTEST IS VOID IN PUERTO RICO AND WHERE PROHIBITED. This Contest is subject to federal, state, and local laws and regulations, including tax laws. Certain restrictions may apply. Sponsor is not responsible for late, lost, stolen, mutilated, incomplete, illegible, misdirected, or postage-due mail. Entries void if the Sponsor determines the entry to not be an original, or if the entries are illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained through fraud or theft. 

Agreement to Rules. Participants also agree (a) to be bound by these Official Rules and (b) if he/she wins that Sponsor may use each Winner’s name, city and state of residence in any publicity or advertising relating to the Contest or future promotions without compensation or approval (except in Tennessee and where prohibited by law). All federal, state and local taxes, fees and surcharges on prizes are the sole responsibility of the prize Winner. In the event that the selected Winner(s) of any prize are/is ineligible or refuses the prize, the prize will be forfeited and Sponsor, in its sole discretion, may choose whether to award the prize to another Winner.

For Canadian Entrants Only. In addition to the above, to be declared a Winner, selected Canadian entrants must have first correctly answered, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered at a mutually agreeable time. If the selected Canadian entrant fails to correctly answer the skill-testing question, he/she will be disqualified.

Disputes. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Oregon. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of jurisdiction.
